Utah Supreme Court considering XanGo case

Deseret News
The Utah Supreme Court heard arguments Monday from a group of investors who are challenging the dismissal of a case they filed against six founding members of Lehi multilevel-marketing company XanGo LLC.

The legal issue that the justices will consider is whether 4th District Judge Fred Howard rightfully dismissed the case and correctly applied Utah Rules of Civil Procedure.

The investors, who identified themselves as Angel Investors LLC and as a "few neighbors and friends" who "pooled their savings and invested it in an unknown startup company called XanGo," filed lawsuits in 2006 and 2007 against the company, which sells juices and personal-care products.

The original court complaints are sealed, but at the court proceeding Monday, the Angel Investors' attorney, Mary Anne Wood, said the investors "became concerned by evidence of extravagant lifestyle and compensation" of the six founders — Aaron Garrity, Bryan Davis, Gary Hollister, Gordon Morton, Joseph Morton and Kent Wood.

XanGo Preps Skin Care Launch

Inside Cosmeceuticals
XanGo LLC will officially launch its new brand, Glimpse™ Intuitive Skin Care, to the U.S. and Canadian markets during its sixth annual convention in early November. The personal care line was created using “green” chemistry to deliver mangosteen’s health benefits in a topical form to nourish the skin. XanGo is using a proprietary ingredient formula called BioActive X3 Complex™ in its skin nutrition system to deliver xanthones and other phytonutrients from the mangosteen.

“We are conscious both of the fact that you are what you absorb and what we put into the environment eventually returns to our bloodstream,” said Beverly Hollister, senior vice president. “XanGo has used clean ingredients in Glimpse that do not mutate or harm any organisms downstream, protecting the environment we all live in.” Hollister also noted the company signed the Compact for Safe Cosmetics, pledging that all the products in Glimpse meet established European Union formulation standards and are free of chemicals known or strongly suspected of causing cancer, mutation or birth defects.

Company builds $1 billion juice business

Business Week:
"On stage at a sales convention, XanGo executive Joseph Morton said that when he first stumbled across mangosteen, a tropical fruit with purported curative powers, 'I didn't have to have it confirmed in the New England medical journal before I would listen.'

The multilevel marketing company has built a huge business around its mangosteen-based juice, which it promotes as an immunity booster. The company still hasn't proved its health benefits -- which it says could include a stronger immune system and improved joint function -- to skeptical experts. XanGo's Web site includes a disclaimer, noting the juice is not meant to treat or prevent disease. A lab test arranged by The Associated Press found its antioxidant power to be on par with other fruit juices.

Morton, a 37-year-old triathlete nicknamed Ironman Joe, was on a business trip in Malaysia when he saw mangosteen, a white delicacy wrapped in a blood-red leathery shell, on the dessert menu."

XanGo sellers flock to SLC

Salt Lake Tribune:
"The 10,000 people flooding Salt Lake City this week for the annual XanGo convention are a testament to the phenomenal growth of the quirky Utah County supplements company with a funny name. The company's fourth annual convention began Wednesday but doesn't get into full swing until general sessions Friday and Saturday at the Salt Palace Convention Center. This year's event will include distributors from 18 foreign countries, as well as the United States, who will be celebrating that growth. One sour note unlikely to be discussed, however, is a lawsuit facing the company claiming that its principals engaged in self-dealing and used XanGo assets for personal use. Launched in 2002 with 14 employees and leased offices, the privately held, multilevel marketing company now occupies 300,000 square feet of office space in three buildings at Thanksgiving Point in Lehi for its more than 700 employees.
